| We sell handcrafted and regular mass merchandised gift and home decorations. |

| To maintain a high level of quality in our stores we jury every crafter before they are accepted. For more information, please click here for a link to the crafter information page. |

| Why should I buy from you? |
| We are a family business that has been selling in our Utah stores since 1992. We strive to always be the best we can be and give our vendors and customers 100%. |

| Do you offer gift cards? |
| Yes. You can buy gift cards at any of our three locations or here on our website. |
| Unfortunately we are not able to redeem Gift Cards on our website at this time. |

| How long are the lease agreements? |
| The Lease agreements last for six months and are automatically renewed unless prior 30-day written notice is given at your 5-month mark. |

| Can anybody be a crafter in your stores? |
| Yes. As long as your product is accepted by each store's jury committee. |

| How much are booth fees? |
| Booth fees vary by location, but start at about $75 a month (4'x2'). Contact the store you are interested in joining for more information. |

| Do I have to live in Utah to become a crafter? |
| No. As long as your product is accepted by each store's jury committee you can be a crafter. Our stores will restock for you with items you ship. |

| Is my Security Deposit Refundable? |
| Yes. So long as you fulfill the terms of your license agreement and no funds are left outstanding. |

Internet Store Returns - This policy applies to those items purchased through quiltedbear.com |
| The Quilted Bear accepts returns only within 30 days of shipment and once you have received a Return Merchandise Authorization number (RMA) from customerservice@quiltedbear.com. The buyer may return any item(s) purchased through quiltedbear.com (with the above listed requirements) to any of the three Utah locations--or to quiltedbear.com. The buyer is responsible for return shipping expenses as well as all other shipping expenses under all circumstances. All returned non-defective merchandise must be in original purchase condition with the original packaging intact and include the original receipt/invoice/packing slip, etc. All returns that are eligible for credit are subject to a 15% restocking fee. The Quilted Bear will issue credit upon approval of returned merchandise. The Quilted Bear will not issue credit for returned merchandise damaged in shipment, in such a case the customer should contact the shipping company. |

| We at The Quilted Bear value your privacy, as such we will at no time sell or give out your personal information. We may from time to time send you special coupons or promotions that we think you might be interested in. | Security is our number one priority. All on-line transactions are sent through our secure server and encrypted with 128-bit technology. Once we receive your information through the internet, only trusted, authorized employees will process the payment to make sure your information is handled with the utmost level of security. |

| Processing Time |
| You can expect your order to be processed within approximately 24-48 hours, provided the items are in stock and there are no problems with payment verification. Quiltedbear.com does not guarantee same day-shipping. Orders are not processed on weekends and holidays. |

| Gift Card Terms and Conditions |
| Gift Cards are only redeemable at participating Quilted Bear locations. The card is only good for merchandise and is subject to the terms and conditions of use as outlined by the Quilted Bear Gift Card Program. Risk of loss and title for card passes to purchaser on transfer. The Quilted Bear is not responsible for any loss or damage resulting from lost or stolen cards or use without your permission. Quilted Bear Gift Cards have no expiration date or dormancy fees. Use of this Card constitutes acceptance of these terms. At this time we do not have the ability to process gift cards on quiltedbear.com. |

| Recordings |
| The Quilted Bear does not consent to having any telephone calls recorded and reserves the right to terminate any call that is being recorded. Customer agrees not to record any call with The Quilted Bear unless Customer has provided clear and conspicuous notice to The Quilted Bear and has received prior written consent from The Quilted Bear. |

| General Terms and Conditions |
| Payment Terms; Orders: An order is not binding upon Quiltedbear.com until it is accepted; Quiltedbear.com must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card, or some other method prearranged with Quiltedbear.com. You agree to pay the amount(s) due as specified on the invoice, and you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater. |

| Risk of Loss |
| Quiltedbear.com will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s) and risk of loss passes to the Customer upon delivery to the carrier. Quiltedbear.com reserves a Purchase Money Security Interest in the product(s) until Quiltedbear.com receives the full amount due. Customer agrees to allow Quiltedbear.com to sign appropriate documents on Customer's behalf to permit Quiltedbear.com to protect its Purchase Money Security Interest. Quiltedbear.com will advise Customer of estimated shipping dates, but Quiltedbear.com will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes. |

| Governing Law and Jurisdiction |
| Any dispute arising out of or related to these Terms and Conditions or the sales transaction between Quiltedbear.com and Customer shall be governed by the laws of the State of Utah, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. Quiltedbear.com and Customer consent to the exclusive jurisdiction and the exclusive venue of the State Courts of the State of Utah, Salt Lake County, to resolve any dispute between them related hereto, and the parties waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against Quiltedbear.com that is more than one year after the date of the applicable invoice. |

| Severability |
| If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Utah law. |

| Waiver |
| The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing. |

| Entire Agreement |
| These terms and conditions, together with Quiltedbear.com's invoice regarding the product(s) ordered by Customer, are the complete and exclusive agreement between Quiltedbear.com and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between Quiltedbear.com and Customer relating to the subject product(s). This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage. |
